In examining the different experiences of truth, he aims to "present the hermeneutic phenomenon in its fullest extent.

This book presents an innovative reading of Daoist philosophy that highlights the critical and therapeutic functions of satire and humor. Moeller and D'Ambrosio show how the Zhuangzi expounds the Daoist art of "genuine pretending" the paradoxical skill of enacting social roles without submitting to them or letting them define one's identity.

Justice, equality, and righteousness—these are some of our greatest moral convictions. Yet in times of social conflict, morals can become rigid, making religious war, ethnic cleansing, and political purges possible. Morality, therefore, can be viewed as pathology-a rhetorical, psychological, and social tool that is used and abused as a weapon. An expert on Eastern philosophies and social systems theory, Hans-Georg Moeller questions the perceived goodness of morality and those who claim morality is inherently positive. Critiquing the ethical "fanaticism" (...) of Western moralists, such as Immanuel Kant, Lawrence Kohlberg, John Rawls, and the utilitarians, Moeller points to the absurd fundamentalisms and impracticable prescriptions arising from definitions of good. Instead he advances a theory of "moral foolishness," or moral asceticism, extracted from the "amoral" philosophers of East Asia and such thinkers as Ludwig Wittgenstein and Niklas Luhmann. The moral fool doesn't understand why ethics are necessarily good, and he isn't convinced that the moral perspective is always positive. In this way he is like most people, and Moeller defends this foolishness against ethical pathologies that support the death penalty, just wars, and even Jerry Springer's crude moral theater. Comparing and contrasting the religious philosophies of Christianity, Daoism, and Zen Buddhism, Moeller presents a persuasive argument in favor of amorality. (shrink)

Guo Xiang's (252-312) reading of the famous "Butterfly Dream" passage from the Zhuangzi differs significantly from modern readings, particularly those that follow the Giles translation. Guo Xiang's view is based on the assumption that the character of Zhuang Zhou has no recollection of his dream after awakening and therefore does not entertain doubts about what or who he really is. This leads to a specific understanding of the allegorical and philosophical meaning of the text that stands in contradistinction to most (...) modern interpretations. “Marx na Universidade!” Esta palavra de ordem sinalizou as reivindicações do Movimento Estudantil, que agitou as universidades alemãs há mais do que cinco décadas, refletindo sobre a missão político-social da formação universitária. O fato de, naquele tempo, a indicação de uma aula sobre a teoria de Karl Marx ter sido sacrificada pela censura dos órgãos políticos da universidade tornou-se incompreensível em nossos dias.[1] Pelo contrário, depois da preocupação intensa com a teoria marxiana nas décadas passadas, o interesse nela parece ter (...) diminuído rapidamente. Acho que foram sobretudo duas razões que levaram a esse processo. Em primeiro lugar, a crítica da economia política foi aceita como teoria científica, tendo enfraquecido assim seu potencial crítico em relação ao desenvolvimento real das sociedades cunhadas pelo capitalismo tardio. Ela tornou-se apenas uma base entre outras na compreensão científica da realidade social.[2] Além disso, a teoria, ela mesma, contém traços objetivistas ao apresentar a análise das estruturas materiais e econômicas, fazendo desaparecer o sujeito humano — fato este, que levou a teoria a aproximar-se aparentemente aos dogmas positivistas da moderna ciência. A teoria de Marx correria, por isso, o risco de mover-se na vizinhança do positivismo científico sacrificando seu impulso emancipatório. Como pôde essa perversão surgir na recepção dessa teoria? Por que esta teoria tão ambiciosa perdeu seu potencial político, deixando-se incluir no pluralismo das teorias científicas? Achando que a teoria de Marx em si mesma não foi inocente quanto a esse processo ou, ao menos, a esse risco, não quero dizer que tivesse refletido de modo insuficiente sobre a emancipação humana. Muito pelo contrário, provarei que a história de sua recepção, assim como a construção teórica da crítica da economia política dão razões significativas para obrigar seu autor a destematizar os sujeitos humanos e, por isso mesmo, chamar a atenção a esse sujeito desaparecido. Em dois passos, explicarei a seguir as razões fundamentadoras dessa tese à primeira vista paradoxal. Na primeira parte da argumentação examinarei o desenvolvimento da teoria de Marx, que se lê como processo de abandono do discurso sobre o sujeito humano, ao passo que na segunda localizarei o destino dos sujeitos e da perspectiva emancipatória, provocados pelas razões internas dessa teoria. Finalmente, incluirei alguns pontos caraterísticos de uma subjetividade humana não dominada pela alienação vigente nas nossas sociedades capitalistas, extraindo assim uma perspectiva produtiva da argumentação anterior. Originating from a confrontation with the contemporary French thought, especially with Jacques Derrida, the article discusses the question of the relation between text and interpretation. It receives the basic impulse for the deliberation on the theme from the tradition of hermeneutics and from the philosophy of Martin Heidegger, from his considerations upon the subjects of the circle of understanding and the phenomenon of language. What is the relation of the text towards the language? What comes from the language forth into (...) the text? What does understanding between speakers mean and what does it mean that there can be commonly given to us something like texts, or even that in mutual understanding something comes into being that is, like a text, one and the same thing for us? How has the concept of the text been able to undergo such a universal extension? In this theme more is at stake than reflections upon the methodology of the philological sciences. English summary: Gadamer's main work, Truth and Method, will be published in 2010, exactly 50 years after the first edition, in a slightly corrected version as an inexpensive student edition. This is seen as one of the few standard works of German post-war philosophy which has achieved worldwide recognition. The huge reaction to this is surprising for many reasons, among other things because in this work an important new theory is presented in intimations only using the author's own conceptual instruments; (...) in fact the author is careful when touching on ancient themes in the philosophical approach to the world. The main question in the work is: What actually happens when we understand? Gadamer focuses on the historical dimensions of understanding, including his famous rehabilitation of prejudice. In addition to the systematic excursus, the book contains an intellectual history of hermeneutics, which is convincing in its virtuosity in dealing with a variety of inspirational figures such as Hegel, Dilthey, Husserl and Heidegger. The amiability and objectivity with which Gadamer invites his readers to a discussion are what account for the enormous influence of this exemplary textbook. Statt die Menschenrechte aus Freiheit rechtfertigen zu können, wird Freiheit als Resultat eines liberalen Verrechtlichungsprozesses gesehen. Die politische Forderung nach globaler Durchsetzung der Menschenrechte macht also aus dem Modell der liberalen Gesellschaft eine in ihren Augen alternativlose Freiheitsordnung, die auch mit Gewalt durchgesetzt werden dürfte.

This paper discusses the meaning of the concept of ‘second-order observation’ used by Niklas Luhmann. Luhmann identifies second-order observation as a defining characteristic of modern world society. According to Luhmann, all social systems construct a social reality on the basis of the observation of observations. Rating agencies in the economy or the peer-review process in the academic system are examples of social mechanisms manifesting second-order observation. Social media also represent organized second-order observation. The paper suggests that in a society based (...) on second-order observation, ‘genuine pretending’ is an adequate mode of existence. This notion is derived from the Daoist text Zhuangzi. It indicates a disassociation from social roles which allows their performers to exercise these roles with ease and, at the same time, maintain a state of sanity. (shrink)

Innovative techniques of developmental biology facilitate the artificial creation of embryo-like entities. This contribution analyses, first, whether certain artificially created embryo-like entities are ‘embryos’ within the meaning of existing statutory law definitions laid down in the Embryo Protection Act, the Stem Cell Act and the Patent Act. These definitions are non-uniform and their interpretation and application with regard to artificially created embryo-like entities is not always conclusive. Accordingly, the legal definitions of the term ‘embryo’ should be harmonised and, thereby, adapted (...) to the state of developmental biology. Any such legislative efforts need to be in conformity with the constitution, primarily with the guarantee of human dignity (Article 1‍(1) of the Basic Law). However, said provision cannot provide guidance to the legislature because the constitutional status of both embryos and embryo-like entities in vitro is highly disputed. It is held that this irresolvable debate is due to a fundamental lack of a widely shared experience that such entities possess a supreme unique value. This article argues that in such a situation it is, in the first instance, for the legislature (i. e. parliament) to determine the legal status of embryos and embryo-like entities in vitro. This argument is based on a particular doctrinal approach according to which the individual right to respect of one’s human dignity arising from Article 1‍(1) BL depends on recognition of the relevant entity as being a ‘human’ or a member of ‘humankind’ respectively. Such recognition has, hitherto, not been accomplished with a view to embryos and embryo-like entities in vitro. Against this backdrop, for the time being, the legislature may determine the legal status of embryos and embryo-like entities in vitro, lay down rules regarding their creation and particular use, and, especially, define the legal term ‘embryo’, albeit within some outer constitutional limits. The article, finally, analyses several elements of, and submits a proposal for, a new legal definition of the term ‘embryo’. (shrink)

This volume makes available for the first time in English the most important of Hans-Georg Gadamer's extensive writings on art and literature. The principal text included is 'The Relevance of the Beautiful', Gadamer's most sustained treatment of philosophical aesthetics. The eleven other essays focus particularly on the challenge issued by modern painting and literature to our customary ideas of art, and use that challenge to revitalize our understanding of it. Gadamer demonstrates the continuing importance of such concepts as (...) imitation, truth, symbol, and play for our appreciation of contemporary art, and thereby establishes its continuity with the Western tradition. The essays here are not technical and are readily accessible to the beginning student and the general reader. The collection as a whole serves to illustrate the practice of hermeneutics and to introduce Gadamer's thought. Robert Bernasconi provides an introduction clarifying the central aims of the essays and their relations to Gadamer's major work, Truth and Method, and to the philosophy of art since Kant. This essay attempts to provide a preliminary outline of a theory of identity. The first section addresses what the sociologist Niklas Luhmann has called ‘the problem of identity’, or, in other words, the mind–society (rather than the mind–body) problem: In how far can the internal (psychological) self and the external (social) persona be integrated into a unit? The second section of the essay briefly defines a basic vocabulary of a theory of identity. ‘Identity’ is understood as the existentially necessary formation (...) of a coherence between the ‘self’ (the ‘I’ as it is experienced in thoughts and feelings), its body and its social ‘persona’ (the individual person with its social attributes). Three different major paradigms of identity formation are distinguished from one another: a sincere identity is constructed through a firm commitment of the self to its social roles; an authentic identity is constructed through the creation of a social persona on the basis of one’s unique and original self; a ‘profilic’ identity, as we call it, is shaped by successfully presenting a personal profile under conditions of second-order observation as they prevail, for instance, in the social media, but also in other contemporary social systems. In the third section of the essay, we present a sketch of the historical sequence of these three paradigms of identity. Although these paradigms are not mutually exclusive and can coexist, it seems that sincerity flourished in pre-modern society, while authenticity came to prominence along with the functional differentiation of modern society and is now, along with the increased significance of second-order observation, gradually overshadowed by the influence of profilicity. ZusammenfassungDer Internistenkongress von 1949 war Anlass und Arena einer breit wahrgenommenen Kontroverse zu epistemologischen Fragen der Psychosomatischen Medizin. Der Beitrag verortet zunächst den Kongress in der Nachkriegsgeschichte und zeichnet die Verlaufslinien der Debatte nach. Dabei werden sowohl die Positionen der Sprecher der Psychosomatischen Medizin – Viktor von Weizsäcker und Alexander Mitscherlich – als auch diejenige von Paul Martini, der auf Basis seiner Methodologie klinischer Forschung grundsätzliche Kritik äußerte, rekonstruiert. In einem zweiten Schritt werden die jeweils unterschiedlichen Auffassungen von Kausalität, Evidenz (...) und Subjektivität herausgearbeitet und kontextualisiert. Das Hauptaugenmerk liegt hierbei auf dem konkreten und expliziten Gebrauch dieser Begriffe bei Martini. Schließlich zeige ich, dass diese Ereignisse im Jahr 1949 als Kulmination einer fortdauernden Kontroverse über wissenschaftliche Evidenz in der klinischen Medizin gelesen werden können, die sich mit ihren Beteiligten und Bezugsebenen über mehrere Jahrzehnte erstreckte.
